On January 1, 2015, a new law (IC 9-30-16) went into effect that makes it easier for you to obtain driving privileges after your driver's license has been suspended (by either the court or by the Bureau of Motor Vehicles). While individuals were once able to obtain either a hardship license or probationary license, these have been merged into one special permit.
Am I Eligible to File for a Specialized Driving Permit in Indiana?
Determining your eligibility could be difficult, but there are basic requirements that you must meet. If you never held a valid driver's license in the state of Indiana or currently have a commercial driver's license, you may not be eligible to seek the specialized driving permit. Also, if you were pulled over and refused the chemical test, it may deem you ineligible.
Other reasons you may be unable to obtain a specialized driving permit include:
- an incident in which you were convicted of a driving offense which resulted in another person's death.
- you previously had a permit and have more than one conviction.
If your suspension is a court-ordered suspension, you may file your Indiana specialized drivers permit with the judge in the county your suspension was ordered. If you are suspended by the BMV for any reason including a 5-year Habitual Traffic Violator (HTV), 10-year HTV, or a lifetime habitual traffic violator, you must file in any court in the county in which you reside.
