What Indiana’s Open Container Law Prohibits

Indiana Code 9-30-15-3 addresses possession of certain alcoholic beverage containers in a vehicle’s passenger compartment. It covers containers that have been opened, have a broken seal, or have had some of their contents removed while the vehicle is operating or on the right-of-way of a public highway. The provision can apply to a passenger as well as the driver.

A violation is a Class C infraction, not a misdemeanor, and it isn’t treated as a moving traffic violation under Indiana’s point system. The State must still establish that the facts satisfy each statutory requirement.

Possession Isn’t the Same as Consumption

Indiana Code 9-30-15-4 separately addresses knowingly consuming an alcoholic beverage while operating a motor vehicle on a public highway. That conduct is classified as a Class B infraction. The wording of the citation should identify which provision applies.

Possessing an opened container doesn’t by itself establish that the driver was intoxicated. If operating while intoxicated or another alcohol-related allegation arose from the same encounter, each allegation requires a separate factual and legal review.

When a Storage or Passenger Exception May Apply

Indiana law provides several exceptions based on who possessed the container and where it was stored. The vehicle’s design, seating arrangement, compartments, and the container’s precise location must be considered together.

Relevant statutory exceptions may include:

  • Passenger transportation: Certain passengers in vehicles designed or used primarily to transport people for compensation.
  • Living quarters: Containers located in the living quarters of a house coach or house trailer.
  • Locked compartments: Containers kept in a locked, fixed center console or a similar fixed compartment.
  • Vehicles without trunks: Containers stored behind the last upright seat or in another area not normally occupied by a person.

A loose bottle on a seat raises different questions from one secured in a qualifying storage area. We examine the physical layout and available evidence rather than assuming every alcoholic beverage container inside a vehicle violates the statute.
